The gov has stopped payments and funding to ACORN.  Those on the mailing list received a TEGL(training and employment guidance letter) telling them to stop, ASAP, all funding and contracts with ACORN.

However, all agencies being suspended from their government funding are due a review of the problem.  I believe the ACORN director is correct when she claims what they are doing is unconstitutional.  ALL such agencies are due a review (due process, anyone?).

Now, to the videos.  The question is not what we saw, but what did we not see?  I am sure there is tape we haven't been shown.  How many office's were visited?  Have we seen the tape from ALL offices that were visited?  Were they ever "turned away" or did EVERY office want to council them on their requests?

Furthermore, a good reporter would have checked the law about taping people before they started the project.  They did violate Maryland law (or so I have heard) and they need to be prosecuted for that.  If they are not, then apparently everyone is free to wiretap and video anyone they choose, at any time, for any reason?  What about that whole privacy thing?

And finally, talk is cheap. (in this case, really cheap) It does not appear that ACORN actually did anything to help the ("reporter's) project along.  It appears they only talked about it. (it wasn't even good counseling!)  Again, talk is cheap, usually only action is prosecutable.

And finally, again, Obama was associated with these people YEARS ago. I fought to save our community swimming pool, does that mean that if anyone associated with that project can now indict me as an accomplice if they get into some jam?  Don't think so.

Mark my words, if this come before a judge (even just an administrative law judge), the defunding will be ruled illegal without DUE PROCESS! Sorry, you can't pick and choose which part of the constitution or public laws you want to follow (just like ACORN can't!)

It is great to see Chief Justice Roberts question the constitutionality of the Voting Right Act, but it would have been more impressive if done as part of the ruling and not just in dicta.  Thanks for the update!

# Marsha Breazeale said on Thursday, November 12, 2009 2:54 PM

No. 1: The receipt of funds by ACORN paid over by the USA is the result of a CONTRACT, not the exercise of a RIGHT by ACORN.  The lawsuit needed to assert breach to have any effect, not assert violation of a mis-interpreted constitutionally-protected right.

No. 2: The Defund ACORN Act cannot be a bill of attainder because ACORN holds no "right" to receive federal funding, and the withholding of funding does not impair, restrict or suspend any recognized consitutional right held by ACORN which the USA is required to protect, and "punishment" as set out in the Fifth Amendment can be delivered by government only by the impairment, restriction or suspension of a constitutional right.

No. 3: The USA has a higher public duty to spend tax dollars collected from the citizens in a manner which fulfills the prior-legislated purpose for the collection of those dollars.  To fund ACORN even one more dollar after the USA was placed on actual notice of illegal activities (which is evidenced by the criminal charges filed against ACORN for voter registration fraud before the video tapes surfaced) would have placed the USA in violation of its fiduciary capacity to execute the public trust.  The outrageous and egregious conduct of ACORN-trained and supervised personnel depicted on the tapes shocks the conscience and warrants suspension of possible mis-appropriation of tax dollars until full investigation can be completed.

No. 4: The Federal judicial system needs to write a detailed explanation of its position relative to privilege v. right relative to the First and Fifth Amendments when issuing the Order to Dismiss, to stop other like-minded private organizations from following ACORN's example of abuse of our legal system for political gain.

Justin -

I am a new member.

Friend of Kim Reed's and Cameron Quinn, and have just moved from NYC.

The think tank I do some work for is involved with anti-Acorn work.

There may be some interesting synergies here and possibilities that will allow RNLA to push the issue, as well as be even more in the forefront of potential ACORN prosecutions/suits.

Please give me at call at your convenience.

I will contact you separately with my mobile number.

Why is this news now? Even a casual search on the web will reveal that ACORN actually DID change their name back in June for a few weeks - even on their website - to "Community Organizations International". Where were the pundits then? Was it not yet politically expedient to report this in the mainstream media? Do a Google search for "Community Organizations International" and you will see all the sites that they set up under this new name and have since taken down - The Google results even say "...formerly Acorn"! Why is this not part of the current mainstream news "revelation"?

It seems to me that the democrats have just broken

the law by buying the votes in La and Ne using our tax dollars when our constitution  says taxes shall be APPORTIONED per the extract below.  How about a class action lawsuit on this one?  Yes, I know it seems a bit grandiose but please tell me if I'm wrong.

Thanks,

I'm not certain where to enter my comment on the site, so I'll start here.  I rec'd. an e-mail from Newsmax.com re: DOJ cover-up of the New Black Panthers voter's intimidation case.  I have been following the case via Fox News and am pretty upset about the situation.  The e-mail indicated that readers could donate to have this issue pursued.  My husband and I donate to many such causes but unfor-tunately are not in a position to donate to everything. I think it is crucial that this matter be addressed & seen through to an end for the protection of American citizens but am confused about why we as citizens need to donate to make this happen.  The current administration is clearly breaking the law on both the Black Panther case and by refusing to follow the law (via Obama appointee, Fernandes) regarding the updating of voter registration lists.  And, on the latter issue, it has been proven by the example studies regarding the 2000 election that this law was established for a good reason.  Are we, as citizens, required to donate money to receive protection against members of the government breaking the law?   Please explain.....

Supreme court justices should rule according to the Constitution of the United States. Also, why can't they be elected by the people just like other judges are elected. I also believe that they should have term limits. Right now Supreme Court Justices are appointed by the President and it has been noted that these justices are chosen not only for their knowledge etc.. but also whether they are liberal or conservative. This takes away the impartiality that should exist in the Federal Supreme Court.

Funny that you have to show your ID to open a bank account, get into a bar, buy alcohol, cash a check, but it is disenfranchising to have to show you are a citizen of a state, this one Wisconsin, in order to vote. No less with a multitude of types of picture ID's, the state one is free. The state should vote to not have to use an ID for anything at all, including buying alcohol, getting into bars, driving, as well as getting on a plane to fly. # Rick Hasen said on Tuesday, March 27, 2012 10:11 AM

My response is at electionlawblog.org and below (without links):

Michael Thielen digs himself deeper into a hole. The released chapter of my forthcoming book discusses the best academic studies available on voter i.d.  The simple reason my book does not cite any evidence from the Carter-Baker commission is its age: it predates the Indiana voter i.d. law (the first of the stricter voter id laws implemented).  Instead, I focus on the actual empirical work on voter id, including important work by Pitts, Erikson and Minnite, and Ansolabehere and Persily.  There is no original empirical research in the Carter-Baker report: only (unsubstantiated) claims about voter confidence, claims which Ansolabehere and Persily tested in an article published later in the Harvard Law Review.

The truth?

Virtually no evidence that voter i.d. laws prevent the kind of fraud (in person, impersonation voter fraud) which is a serious threat in American elections.

No evidence of a link between voter i.d. laws and voter confidence.

The chapter explains these points in detail.  I have yet to see good empirical evidence refuting either of these two points.  Certainly nothing in Carter-Baker does.

And, for the record, I have come out before and in the last chapter of the book I will come out again in favor of a national voter identification card, with all the costs paid for by the government, and registration conducted by the government (not third party groups) and the optional use of a thumbprint instead of the voter identification card for voters who choose to use it.  This would be part of a package of fundamental reforms to make our election system more uniform, efficient, and fair.

In other words not the best or even academic studies but rather only "studies" that support your and the far left's point of view.  You use an "Internet Muckraker" instead of a commission of liberal and conservative experts on Carter Baker.

You rely on a study by someone who learned about voting (cheating?) while working for ACORN affiliate Project Vote but ignores PhD Robert Pastor,  director of the Center for North American Studies and the Center for Democracy and Election Management and an appointee of the Clinton and Carter administrations.

Sorry Professor Hasen, your argument is not factual and not even on point.

I read this about Coke backing off, sad. All of these companies have the bank to withstand any of this extortion type activity.  Insulting to the group of people that the libs think are incapable of registering to vote. Everyone should have to register to vote and show ID to vote. We show ID's to buy beer/wine/liquor, kids have to to get into R rated movies, we do to open bank account, get a loan, get on a plane, at check out counters to verify we are who is on our credit cards, to get on medical staff at hospitals etc etc etc.
